Abigail Simon Biography

Abigail Simon, a former teacher, was accused of having s*x with Jose Diaz, a Catholic Central High School student. During the charges, Abigail was 35 years old and the boy was 15 years old.

The boy’s mother realized the student and teacher’s relationship when she noticed 1000 steamy conversations between them on his phone. She was sacked from the school once the case became public.

It was revealed in the text chats that they used nicknames like boo and baby girl to communicate with each other. The youngster used to slip out of his house and Abigail would give him a ride to her house where the deeds took place, thus their relationship was kept covert.

This case was also the subject of a Dangerous Liaisons episode of NBC’s Dateline, which aired on June 5, 2015.

Simon was convicted to eight to twenty-five years in jail for first-degree illegal s*xual behavior in January 2015. She was a tutor at Catholic Central High School and had a 15-year-old son with whom she had a relationship.

An obligation for lifetime electronic surveillance once she is released from prison was one of the arguments she raised with the Court of Appeals. The condition is unlawful, she claims because it is “cruel punishment.”

The Court of Appeals had a different opinion.

“With regard to the severity of the penalty, although the defendant is subject to LEM for the rest of her life, LEM does not prevent the defendant from traveling, working, or otherwise moving about as she pleases once she is freed from prison,” they said.

Before determining whether to hear Simon’s case, the California Supreme Court agreed to wait for the outcome of another sex offender’s appeal.

At Justin Comer’s sentence in St. Clair County, a judge omitted to check a box or line to place him on lifetime electronic surveillance. The electronic monitoring was ordered by a different judge 19 months later.

In a June ruling, the Texas Supreme Court concluded that the following judge had overstepped his authority and that Comer’s initial sentence would stand.

The Comer case had the potential to explore the legality of lifetime electronic surveillance a few months ago. The judges, on the other hand, chose not to address the problem.

Simon’s choices today, according to James Benison, a senior attorney in the Kent County Prosecutor’s Office appeals division, are limited, with a low possibility of success.

They include requesting that the United States Supreme Court review her case, attempting to get a writ of habeas corpus in federal court, and submitting a motion for relief from judgment.

Simon was arrested in January 2015, and she is scheduled for release in November 2022.
