Olivia Wilde has won a small victory in the custody battle with Jason Sudeikis over their two kids, and it has to do with where the kids will live.

According to court documents that TMZ got on August 10, Olivia, Jason, their lawyers, and judges in New York (where Jason lives) and Los Angeles (where Olivia lives) met via a video call in July. Before they broke up in November 2020, the ex-couple dated for almost 10 years. Now, they are in the middle of a custody battle over their two kids, Otis, 8, and Daisy, 5.

During that meeting, the news source says, the two judges in charge agreed that California, not New York, was the children’s home. Page Six got court documents that show that this means that Jason’s first case in New York has been dropped.

But, as the article said, the judge’s decision doesn’t mean that the case is over since the move means that the custody case will be held in L.A. County from now on.

The small win for the director of “Booksmart” came just hours after Olivia legally asked the court to throw out Jason’s custody petition, according to court documents cited by the Daily Mail on August 10.

Olivia called her ex-way husband for serving her with custody papers in April “aggressive” in the legal papers she filed against him. (Just so you know, Olivia was served while she was promoting her movie Don’t Worry Darling on stage at CinemaCon).

Olivia, who is dating her co-star on “Don’t Worry, Darling,” Harry Styles, said in her court filing, “It was clear that Jason’s actions were meant to scare me and catch me off guard.” “He could have served me in a quiet way, but instead he chose to be as rude as possible.”
